A marriage contract is a legal agreement between a couple that is planning to get married. Normally, a marriage contract is used to determine which spouse will keep property and other possessions if ever both parties decide to end the relationship. But this is not always the case; there are also some marriage contracts that include the commitment the partners in a marriage make to one another and conditions of the marriage. There are times that these contracts can also cover the details of how the kids who were born before the marriage will be taken cared if ever they get separated.
1Mutual Agreement
The written offers of the agreement.
2Genuine Assent
Offers and acceptance have to be free of duress, coercion, threat, deception, and fraud.
3Reciprocal Consideration
A party has to do something for another, if the other party will carry out a service or offer a product.
4Legality
Contracts normally has to be public; through that, everyone will know that the contract exists. There should be a line where both parties can sign the contract after agreeing to everything.
Step1
Write the date of when the marriage contract will be signed. It is also very important the real full name of the couples is there in the contract.
Step2
Clarify that you would like to choose your own property rights. Say that you’re going to make your own possessions division decisions independent of the default possessions laws of the state.
Step3
State your right to get a professional advice from an independent attorney. To make sure that neither party was rushed or forced into signing the contract, you have to say that both parties have had the chance to have the contract appraised by a professional lawyer.
Step4
Make sure that both parties know about the contract. Another common section is a statement that the parties completely are aware and agree to the provided.
Step5
Remember that the contract depends on the marriage. Of course, if both partners choose not to get married, the contract wouldn’t be effective. Remember this fact in your agreement.
