In general, sublease agreement is a legal contract between a tenant, which is leasing a property from its owner, and a new tenant. Subtenant gets a right to share or take over the premises from the first tenant. He pays his rent to the first tenant, and the sublease paid the rent to the owner of the premises. The first tenant is responsible for paying the rent to the owner of the property, as well as for all the possible damages on the property in eyes of the owner. In most cases, the first tenant must have the permission from the owner if he wants to get a sublease.
Sublease Agreement is a simple contract between two parties. However, like any contract, it must contain some information.

This contract contains general information about the first tenant and the second tenant, as parties in a contract.

It must contain information about the property which is a subject of the sublease, as well as all the important information about the rent, time when it should be paid and any other significant data.

Information about the procedure in a case of damage to the property or any disputes between parties should be included into a Sublease Agreement.

Less, but not the least, contract must be dated and signed by all the parties.
Good news is that it is not that hard to create a sublease agreement. With some help online, you can do it in a couple of hours. However, it is always a good idea to check everything well before signing and if you have some doubts, talk to the professional about it.

At the top of the contract, write the date and place to create an effective date.

State the important information about both parties, which includes their names and addresses.

Name the property that is a subject of the lease. When you are doing that, be specific. For example, if you are leasing one room in apartment, say that loud and clear. Write down all conditions of the leasing.

Write down details about the amount of the rent, time when rent has to be paid, possible deposit, paying the bills and other details about the money.

If the sublease includes some maintenance of the property like mowing the lawn or other, make sure to include it in the Sublease Agreement as well.

In most cases the original tenant is responsible for all the damages done to the property, no matter who did it. Discuss it in an agreement with the sublease.

Always remember to write a part about potential disputes and their solving.

At the bottom, place date and sign line. Make sure there is plenty of space for all signs.

Create three copies, one for each party that signs the contract and one for the owner of the property.

There is no need to have a help of a professional when you write a sublease. However, if you are not sure about the agreement, you can ask for a professional help, at least to read an agreement and give you a professional advice. Also, before then you even start thinking about the sublease; make sure your landlord agrees with it.

While writing a contract, check every information twice. Read the contract carefully before you sign it and correct any possible mistakes. Remember, once you sign that contract, it becomes obligatory to you, in good and in bad.

Check the reliability of the other party, especially if you are a tenant which gives the sublease. Your responsibilities, in that case, are bigger and there is no need to create problems in your life because of the irresponsible sublease. In most cases, you are responsible for all the damages done to the property in the eyes of the landlord. Also, you will have to pay the rent to the landlord even if you sublease is not paying to you.

Think twice before you do anything. The sublease may sound simple and easy, especially if you are leasing a bedroom to a friend or a family, but it can contain many dangers to your nerves, wallet and even creditability.
