This is basically a form that was created in order to showcase the rental process of a property. This has to be signed by the tenant and landlord when a property is rented by the latter. This is a necessary document for any person that wants to legally rent a property, and it has to be signed by both parties in order to be valid.
In the residential lease agreement you will need to find the rent frequency and amount, when and how the rent increases, the security deposit, additional charges, any guest rules, signing incentives, the contract length, an option to purchase the property or in some situations a clause to renew/render the contract obsolete.
Step1
In order to create and complete a residential lease agreement you will need to either download a template from one of the links displayed above or create from scratch, depending on your needs.
Step2
You will need to add the name of both landowner and tenant, then continue by completing the requested information. The landowner needs to add the necessary terms, including the time when the lease will start and end, with complete details and addendum if that is needed.
Step3
Once this is included, the residential lease agreement will also require the addition of a section about the monthly rent. This is self-explanatory, however you do need to add some information regarding a possibility of renting prices going up and how much more than the normal rate. This is a necessity and it’s a good idea to add it in there as it will help a lot.
Step4
Use of premises is also a great point to touch, because in this residential lease agreement you need to be certain that a specific limitation or at least determination is made in order to determine how free or limited the entire rental process really is. Any rental conditions can end up being thrown here if they are requested, so keep that in mind.
Step5
If needed, you can also add some space for alterations and improvements. While most tenants will leave the property the way it is, some will need/want to make improvements, so you have to state what improvements you are ok with, what they can focus on, etc.
Step6
Moreover, the usage of hazardous items and utilities will need to be addressed as well. Sure, while the residential lease agreement is a very important document, the reality is that without such a clause you can’t restrict the tenant from doing just about anything, including the use of hazardous materials that can harm your house. With this type of document you will be able to maintain that level of control and security.
Step7
If you want, you can also create a security deposit section in the residential lease agreement, which is actually recommended if you want the tenant to add a deposit before actually moving in your establishment. This is a very good idea if you want to stay safe!
1
You need to always focus on the financial responsibilities of the tenant. If this is not added, then you won’t have any limits and this can lead to some bad results at the end of the day. Make sure that this is included if you want to avoid any trouble.
2
At the same time, you also need to write a policy section that will outline your rights as a landlord, as this is indeed a necessity.
3
Always make sure to address the responsibilities of the tenant, because this needs to be an important portion of the agreement.
4
Alterations need to be specified immediately, because if you do opt for a residential lease agreement, you do need to make sure that the contract is created properly and it protects you in case any unwanted situations appear.
5
Of course, you also need to add a pet section, especially if you’re not a pet lover or if you don’t want to allow pets in your home.
Both of these documents are specific to renting a property, but each one addresses a specific time period. The rental agreement was created in order to provide tenancy for a shorter period of time, usually around a month or so. The landlord is free to change any of the terms if he wants, although prior written notice is needed in such a situation, just keep that in mind.
On the other hand though, the lease agreement will offer the ability to actually choose a term for the lease. It can be anywhere from 6 months to a year or even longer, it all comes down to an agreement within the two parties. An important thing to note here is that once the lease expires it won’t be renewed automatically whereas the rental agreement will get a renewal without the need of both parties being present there.
